RESOLLJTION NO. <br />RESOLUTION OF THE CITY COUNCIL O`IERpULING <br />AND DENYING PROTESTS AND MAKING CERTAIN <br />FINDINGS" IN A SPECIAL ASSESSMENT DISTRIC <br />- `CITY OF. COLTON <br />WHEREAS, this City Council has, by Resolution, clared its <br />intention to order the construction of certain ubli.c works of <br />improvement, pursuant to the terms and provis'ons of the -"Muni=- <br />cipal Improvement Act of 1913", being Divisi n 12 of the Streets <br />4.and Highways Code of the State of Cali.forni , in a special assess- <br />ment district in said City known and desig ated as <br />ASSESSMENT DISTRICT NO. 7 -1 <br />[MT. VERNON AVENUE AND COOLEY.DRIVE, PHASE IIJ <br />(hereinafter referred to as the "Assessment District"); and, <br />WHEREAS, certain owners of prope liable to be assessed for <br />improvement have filed written _rot sts or objections and deli- <br />vered the same to the Clerk_ no a er than the: hour set for <br />hearing such objections; and, <br />WHEREAS, at the time set for al Public Hearing,, all protests <br />and objections were duly hear considered by the City Council <br />and all matters as to the met o and formula of the assessment <br />spread and the determination a to whether or not the property <br />did receive a benefit and wh h r the assessments were apportioned <br />in accordance to benefit were <br />Council. and and considered by this city <br />NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CI OF COLTON <br />CALIFORNIA, AS FOLLOWS <br />SECTION 1. That theabove recitals are all true and correct. <br />SECTION 2. That a �Od.the <br />sts and objections of every kind and <br />nature b same hereby are, overruled and <br />denied, an 't is further determined that said pro- <br />tests ob' ctions are made by the owners of less <br />than on half (1/2) of the area of property to be <br />assessed r said improvements within said�Assess- <br />ment stri <br />SECTION 3. That it is hereby further determined that all oro - <br />per ies within the boundaries of the Assessrlen't <br />Di trict receive a local and direct benefit from the <br />w ks of improvement as proposed for said Assessment <br />strict and it is hereby further determined and de- <br />lared that all assessable costs and expenses have <br />been apportioned and spread over the properties <br />within the boundaries of the Assessment District in <br />direct proportion to the benefits received thereto. <br />
