RESOLUTION NO. 3849 <br />RESOLUTION OF THE CITY COUNCIL ORDERING <br />WORK TO BE EXECUTED AND PERFORMED BY CITY <br />FORCES IN A SPECIAL ASSESSMENT DISTRICT. <br />CITY OF COLTON <br />WHEREAS, this City Council has formed a special assessment district <br />Pursuant to the terms and provisions of the "Municipal Improvement <br />Act of 1913", being Division 12 of the Streets and Highways Code of <br />the State of California, for the construction of certain public <br />works of improvement; said special assessment district known and; <br />designated as <br />ASSESSMENT DISTRICT NO. 78-1 <br />[MT.-VERNON-AVENUE AND COOLEY DRIVE, PHASE III <br />(hereinafter referred to as the "Assessment District"); and, <br />WHEREAS,.pursuant to Section 10506 of the Streets and Highways Code <br />of the State of California,_ any time after the preliminary approval <br />of the Report, this City Council, may, by a Resolution adopted by a <br />vote of two-thirds (2/3) of its members, order that the City, it- <br />self, execute all or any portion of the improvements in accordance <br />with the plans and specifications, and it is hereby determined, at <br />this time, to be more economical and within the best public interest <br />and general welfare to do so. <br />NOW, THEREFORE, IT IS HEREBY RESOLVER BY THE CITY COUNCIL OF THE <br />CITY OF COLTON <br />CALIFORNIA, AS FOLLOWS: <br />SECTION 1. That the above recitals are all true and correct. <br />SECTION 2. That pursuant to Section 10506 of the Streets and <br />Highways Code of the State of California, this City <br />shall perform certain works of improvement in the <br />AssessmentDistrictand authorization is also given, <br />if necessary, to -employ the labor and provide the <br />materials, appliances, and supplies, all necessary <br />to carry out the following portions of the work: <br />The construction and installation of certain <br />street lighting improvements, including under- <br />ground wiring and appurtenances and appurtenant <br />work, as shown on the plans for the above refe- <br />renced Assessment District. <br />SECTION 3. That it is hereby further determined that said works <br />Of improvement above mentioned are necessary for the <br />Assessment District and are determined to be in the <br />best interests of the property owners to be performed <br />by the municipality, and that the.costs and expenses <br />
