RESOLUTION NO. 3874 <br />1 <br />RESOLUTION OF THE: CITY COUNCIL OF THE CITY <br />2 OF COLTON TO DETERMINE THE DISABILITY FOR <br />RETIREMENT PURPOSES OF A LOCAL SAFETY MEMBER <br />3 <br />4 WHEREAS, the City of Colton (hereinafter referred to as Agency) is a <br />5 contracting agency of the Public Employees' Retirement System; and, <br />6; <br />WHEREAS, the Public Employees' Retirement Law requires that a con - <br />7 tracting agency determine whether"an employee of such agency, in employment <br />8 in which he is classified as a local safety member, i.s disabled for purposes <br />9 of the Public Employees' Retirement Law and whether such disability is <br />10 industrial" within the meaning of such law; and, <br />11 WHEREAS, an application for disability retirement of RAYMOND WHITE em - <br />12 ployed by the Agency in the position of Firefighter has been filed with <br />13 the Public Employees' Retirement System; and, <br />14 WHEREAS, the City Council has reviewed the medical and other evidence <br />15 relevant to such alleged disability; <br />16 NOW, THEREFORE, BE IT RESOLVED that the City Council find and determine <br />17 and it does` hereby find and determine, that RAYMOND WHITE, is incapacitated <br />18 within the meaning of the Public Employees' Retirement Lawfor performance <br />19 of his 'duties in the position of Firefighter as of November 8, 1978; and,. <br />20 BE IT FURTHER RESOLVED that the City Council find and determine, and <br />21 it does hereby find and determine, that such disability istheresult of <br />22 injury or disease` arising out of and in the course of employment.. <br />23 PASSED, APPROVED and ADOPTED this 7th day of November, 1978. <br />24 <br />25 <br />FRA' A, G0P ALES' y <br />26 ATTEST: <br />27 <br />28Q, <br />HELEN A.
