Employee -initiated <br />education <br />or area development shall not be considered as time actually worked for <br />purposes of computing overtime and normally shall not occur during <br />regular work hours. <br />10. LEAVE OF ABSENCE WITHOUT PAY <br />The language as stated in the Rules and Regulations, Section 5, is as <br />follows: <br />Section 5. Leave of Absence Without Pay: The Personnel Officer may <br />grant a permanent employee a leave of absence without pay for a period <br />not to exceed six months. Any request for a leave of absence for a period <br />longer than six months may be granted only by the City Council. No <br />such leave shall be granted except upon written request of the employee. <br />Approval shall be in writing and a copy filed with the Personnel Officer. <br />Upon expiration of a regularly approved leave, or within a reasonable <br />period of time after notice to return to duty, the employee shall be <br />reinstated in the position held at the time the leave was granted. <br />Failure on the part of an employee on leave to report promptly at its <br />expiration, or within a reasonable time after notice to return to duty, <br />shall be cause for discharge. No absence or leave will be granted when <br />the purpose of the employee is to enter the services of another employer. <br />(As amended by Resolution No. 3344.) <br />11. CONTRACT BAR <br />It is understood that this MEMORANDUM OF UNDERSTANDING shall constitute a <br />bar to any petition or request for recognition in any unit which includes <br />classifications of employees covered by this MEMORANDUM OF UNDERSTANDING <br />-5- <br />
