1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />im <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />26 <br />RESOLUTION NO.4468 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON TO DETERMINE THE DISABILITY FOR <br />RETIREMENT PURPOSES OF A LOCAL SAFETY MEMBER. <br />WHEREAS, the City of Colton (hereinafter referred to as <br />IlAgency) is a contracting agency of the Public Employees' Retire- <br />11ment System; and <br />WHEREAS, the Public Employees' Retirement Law requires <br />that a contracting agency determine whether an employee of such <br />agency, in employment in which he is classified as a local safety <br />member, is disabled for purposes of the Public Employees' Retire- <br />ment Law and whether such disability is "industrial" within the <br />(meaning of such law; and <br />WHEREAS, an application for disability retirement of <br />DOUGLAS P. SHEVALIER employed by the Agency in the position of <br />Police Officer has been filed with the Public Employees' Re- <br />tirement System; and <br />WHEREAS, the City Council has reviewed the medical and <br />other evidence relevant to such alleged disability. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council <br />finds and determines, and it does hereby find and determine, that <br />DOUGLAS P. SHEVALIER is incapacitated within the meaning of the <br />Public Employees' Retirement Law for performance of his duties <br />in the Position of Police Officer as of May 15, 1984. <br />BE IT FURTHER RESOLVED that the City Council finds and <br />determines, and it does find and determine, that such disability <br />is the result of injury or disease arising out of and in the <br />course of employment. <br />
