g: <br />1 of revenue bonds for the Project in accordance with the <br />2 <br />requirements of Section 103(k) of the Internal Revenue Code <br />3 of 1954, as amended;and <br />4 WHEREAS, the members of the City Council are the. <br />5 applicable elected_ representatives to conduct a public hearing <br />6 regarding-, the issuance of the revenue bonds for the Project; <br />and <br />8 WHEREAS, the City Council has conducted a public <br />9 hearing regarding the issuance of the revenue bonds for the <br />10 project and has determined it to be in the public interest to <br />11 issue bonds, the proceeds of which will be used to make a <br />12 loan to the Developer pursuant to a Loan Agreement by and <br />13 between the City and the Developer, all in furtherance of the <br />14 purposes of the Act; and <br />15 WHEREAS, all acts, conditions and things required <br />16 by the Act, and by all other laws of the State of California., <br />17 to exist to have happened and to have been performed pre - <br />18 cedent to and in connection with the issuance of the afore - <br />19 said revenue bonds exist, have happened, and have been per - <br />20 formed -in,regular and due time, form and manner as required <br />21 by law, and the City is now duly authorized and empowered,' <br />22 pursuant to each and every requirement of law, to issue such <br />23 revenue bonds for the purpose, in the manner and upon the <br />24 terms herein provided and <br />25 WHEREAS, said revenue bonds are to be issued pursu- <br />26 ant to an Indenture of 'Trust (the "Indenture") in the form <br />27 presented to this meeting by and between the City and The <br />28 Bank of California, N.A. ('the "Trustee") in an aggregate <br />-2_ <br />
