Based on the entire record before the City Council, all written
and oral evidence presented to the City Council, and the findings made in this Resolution,
the City Council of the City of Colton hereby amends the General Plan land use designation
for the Subject Site, as set forth on the attached Exhibit "Al", from "General Commercial" to
"Low Density Residential" ("General Plan Amendment").
SECTION 2. Based on the entire record before the City Council and all
written and oral evidence presented to the City Council, the Council finds the General Plan
Amendment promotes the goals and objectives of the General Plan, and each element
thereof, and leaves the General Plan a compatible, integrated, and internally consistent
statement of policies. In accordance with the City of Colton General Plan, the proposed land
use classification provides for land uses that are adequately buffered and which do not
adversely affect surrounding property. (See Colton General Plan, p. 2-19.) Most of the
existing infrastructure improvements in this area are in place so that once the Subject Site is
developed it will be adequately served by surrounding public streets. Moreover, designating
the Subject Site to Low Density Residential will promote the availability of additional land to
meet the region's housing needs. Finally, development of the Subject Site in accordance with
the goals and standards of the general plan, as well as the development standards of the
underlying zoning designation will assure that development of the subject site is compatible
with the goals and standards of other general plan elements.
SECTION 3. The City Council has determined the proposed General Plan
Amendment is in the public interest because it provides additional opportunities for
residential development opportunities in Colton.
SECTION 4. In considering this General Plan Amendment, the City Council
has considered the housing needs of the region and balanced those needs against the public
service needs of the residents and available fiscal and environmental resources.
SECTION 5. Based on the entire record before the City Council and all
written and oral evidence presented, the City Council finds the General Plan Amendment
complies with "CEQA" and hereby adopts the negative declaration for the following reasons:
A. The negative declaration and initial study prepared for the Application
contain a complete and accurate reporting of the environmental impacts associated with the
Application. The documents have been completed in compliance with CEQA and the State
CEQA Guidelines.
B. The negative declaration and initial study prepared for the Application
reflect the independent judgment of the City Council.
C. As the decision making body for the Application, the City Council
reviewed and considered the information contained in the negative declaration, initial study
and administrative record prior to approving the Application.
D. All environmental impacts of the Application are insignificant. There is
no substantial evidence in the record supporting a fair argument that the Application will
result in significant impacts.
RVPUB\MXM\679703.1
