(See page <br />5 of Agenda Report; Page 2-1, Section 4.0 of EIR & Initial Study) <br />3. Circulation Element - Goal No. 3 (pp. 7) "Separate vehicular traffic <br />associated with commercial, manufacturing and agricultural uses from residential <br />neighborhoods." The Applications propose to amend an existing use in an area <br />that is already substantially separated from residential neighborhoods. Approval <br />of the amendment will not impact traffic within existing residential neighborhoods <br />as mitigation measures have been required to address project impacts. (See <br />Page 7 of August 24, 2004 Agenda Report; See page 1-8 & Section 5.5 of EIR) <br />4. Noise Element - General Objective & Principle No. 2 (pp 5-7) "To achieve <br />and maintain an environment where noise is compatible with human activities <br />interacting with a variety of land uses./ Control noise exposure from future noise <br />generators so the ambient environment will be kept within acceptable limits. of <br />Approval of the Applications will not generate significant noise sources as <br />conformance with mitigation measures imposed on the Project will mitigate noise <br />impacts to less than significant levels in compliance with City noise standards. <br />(See pages 6&7 of August 24, 2004 Agenda Report; Section 5.3 of EIR & <br />Response to Comments Re Noise Issues). <br />5. Finally, the City Council finds that with respect to the remaining goals, <br />policies and objectives of the General Plan, the proposed Project will not directly <br />conflict with any goals, policies and objectives that are fundamental, mandatory <br />and unambiguous. <br />B. The proposed Project, together with the conditions applicable thereto will not be <br />detrimental to the public health, safety or welfare, or materially injurious to properties or <br />improvements in the vicinity of the Subject Site. The proposed amendment authorizes (1) the <br />installation and operation of a metal shredder as an expansion to an existing scrap metal facility; <br />(2) the construction of an approximate 30' X 250" metal building; and (3) an increase in the <br />volume of railroad transloading. The proposed Project is (1) consistent with the general plan <br />and land use designations for this area; (2) compatible with surrounding uses with the <br />implementation of all mitigation measures; and (3) generates additional job opportunities in the <br />City of Colton. <br />C. The proposed use complies with each of the applicable provisions of Title 18 of <br />the Colton Municipal Code. Except for the proposed overheight wall on the southerly property <br />line, the Project complies or will comply, with adherence to mitigation measures, with all <br />requirements of the Colton Zoning Ordinance (Title 18). (See pages 2-5 of August 24, 2005 <br />Agenda Report) <br />SECTION 3. Based on the entire record before the City Council and all written <br />and oral evidence presented, including the staff report, the attachments to the staff report and <br />EIR (including the addenda), the City Council finds that the proposed 8 -foot wall on top of a 5 - <br />foot high berm ("Proposed Southerly Fence") complies with the requirements for perimeter walls <br />and fences contained in Section 18.38.040(C) for the following reasons: <br />A. Colton Municipal Code, §18.38.040(C) provides that "the height of screening for <br />all storage areas or industrial operations shall be eight feet for all zones." <br />RVPUB\MXM\684167.1 - 3 - <br />
