1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the EIR prepared in connection with the Project sufficiently analyzes <br />both the feasible mitigation measures necessary to avoid or substantially lessen the Project's <br />potential environmental impacts and a range of feasible alternatives capable of eliminating or <br />reducing these effects in accordance with CEQA and the State CEQA Guidelines; and <br />WHEREAS, all of the findings and conclusions made by the City Council pursuant <br />to this Resolution are based upon substantial evidence in the entire record before the City <br />Council, including the record before the Planning Commission in its determination, and are not <br />based solely on the information provided in this Resolution; and <br />WHEREAS, environmental impacts, including environmental impacts identified in <br />the Final EIR as potentially significant but which the City finds can be substantially lessened <br />through the imposition of feasible mitigation measures identified in the Final EIR and the <br />addendum thereto and set forth herein, are identified in the Final EIR and the addendum thereto <br />and are described in Section IV hereof; and <br />WHEREAS, alternatives to the Project that might eliminate or reduce significant <br />environmental impacts are described in Section V hereof; and <br />WHEREAS, the Project will not have environmental impacts which are potentially <br />significant and cannot be eliminated; and <br />WHEREAS, prior to taking action, the City Council has heard, been presented <br />with, reviewed and considered all of the information and data in the administrative record, <br />including the Final EIR and the addendum thereto, and all oral and written evidence presented to <br />it during all meetings and hearings; and <br />WHEREAS, the Final EIR reflects the independent judgment of the City Council <br />and is deemed adequate for purposes of making decisions on the merits of the Project; and <br />WHEREAS, the City has not received any comments or additional information that <br />produced substantial new information requiring recirculation or additional environmental review <br />under Public Resources Code sections 21166 and 21092.1 and State CEQA Guidelines section <br />15088.5; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />RESOLVES AS FOLLOWS: <br />RVPUB�ALB\683610.1 - 3 - <br />
