1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, as of the date hereof, the City and the Agency have also <br />identified funds available from projects budgeted for, but not undertaken or redirected from <br />projects completed with other funding sources; and <br />WHEREAS, the City and the Agency further desire that the Funding and <br />Construction Management Agreement be amended to add road reconstruction projects for <br />the Cooley Ranch Wood Street Subdivision, Cooley Drive from 1-215 to Cooley Lane and Old <br />Ranch Road between Cooley Drive and Mountainview and to provide that these projects be <br />financed with funds in the Special Fund; and <br />WHEREAS, the proposed public improvements are exempt pursuant to Section <br />15301 (c) of CEQA, thereby a Notice of Exemption will be filed with the office of County Clerk of <br />the Board of Supervisors. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES DETERMINE, RESOLVE AND ORDER AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct. <br />Section 2. The City Council hereby approves Amendment No. 2 to the <br />Funding and Construction Management Agreement, in the form presently on file with the City <br />Clerk. <br />Section 3. Provided that the Agency has approved and executed <br />Amendment No. 2 to the Funding and Construction Management Agreement by a date not <br />later than March 1, 2004, the City Manager is hereby authorized and directed to execute <br />Amendment No. 2 on behalf of the City, together with such technical and conforming <br />changes to the text of Amendment No. 2 as may be recommended by the City Attorney to <br />conform the text of the agreement to the specific public works construction and management <br />responsibilities assumed by the City under the Funding and Construction Management <br />Agreement, as amended by Amendment No. 2. The City Manager and the City Engineer are <br />hereby authorized and directed to administer the responsibilities of the City assumed under <br />the Funding and Construction Management Agreement, as amended by Amendment No. 2. <br />2 <br />
