1 <br />2 RESOLUTION NO. R-98-04 <br />3 <br />4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON ADOPTING AMENDMENTS TO THE CITY'S <br />5 LOCAL CALIFORNIA ENVIRONMENTAL QUALITY ACT <br />6 (CEQA) GUIDELINES <br />7 <br />WHEREAS, the City of Colton City Council ("City Council") has previously <br />8 <br />adopted the "Local Guidelines for Implementing the California Environmental Quality Act <br />9 <br />10 [CEQA] (2004 Revision) (hereinafter "Local CEQA Guidelines"); and <br />11 <br />12 WHEREAS, pursuant to the City's Municipal Code, certain nonelected bodies <br />13 such as the City's Planning Commission and Design Review Committee are authorized <br />14 to hear, consider and adopt certain entitlements, including but not limited to conditional <br />15 <br />use permits and variances and site plan and architectural reviews; and <br />16 <br />17 <br />18 WHEREAS, the City Council desires to revise its Local CEQA Guidelines <br />19 regarding authority to approve certain environmental review documents, pursuant to the <br />20 provisions in the State CEQA Guidelines; and <br />21 <br />22 <br />WHEREAS, it is the intent of this Resolution to provide that the Design Review <br />23 <br />Committee possesses the authority to approve certain environmental review documents <br />24 <br />25 under CEQA, including without limitation, the authority to adopt negative declarations <br />26 and mitigated negative declarations, to certify environmental impact reports and to <br />27 make required findings in connection therewith, all subject to appeal of such decisions <br />28 to the Planning Commission and City Council; and <br />1 <br />RVPUB\MXM\677742.1 <br />
