R-04-05 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, <br />PURSUANT TO GOVERNMENT CODE SECTION 21025, MAKING DETERMINATION OF <br />DISABILITY STATUS FOR LOCAL SAFETY EMPLOYEE TERESA MICHEL. <br />WHEREAS, the City of Colton (hereinafter referred to as Agency) is a contracting agency of <br />the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires that a contracting agency <br />determine whether an employee of such agency is in employment in which he is classified as a local <br />safety member; is disabled for purposes of Public Employees' Retirement Law; and, whether such <br />disability is "industrial" within the meaning of such law; and, <br />WHEREAS, the City Council confirms that a Worker's Compensation Claim was filed by <br />Teresa Michel alleging disability from her position as Police Officer; and, <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant to such <br />alleged disability; <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />The City of Colton hereby finds and determines that Teresa Michel is incapacitated within the <br />meaning of the Public Employees' Retirement Law for performance of her duties in the position of <br />Police Officer, that the disability was the result of injury, specifically, to the right middle finger and right <br />hand under the provisions of Government Code Section 21156; and, <br />BE IT FURTHER RESOLVED that the City Council finds and determines that such disability is <br />a result of injury arising out of and in the course of employment. Neither Teresa Michel nor the City of <br />Colton has applied to the Worker's Compensation Appeals Board for a determination pursuant to <br />Section 21166 whether such disability is industrial; and, <br />BE IT FURTHER RESOLVED that the member completed an Industrial Disability Retirement <br />and is separated from her employment in the position of Police Officer after expiration of her leave <br />02/15/05 <br />Reso Teresa Michel IDR 011505 <br />
