1 establish certain fees for towing and storing impounded vehicles, under the Vehicle Code sections cited above as well as under the police power granted to cities by Article XI, 2 Section 7 of the California Constitution and pursuant to the provisions of Government Code 3 section 66016. 4 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: 5 1. Notice of the public hearing at which this Resolution was considered 6 was properly given pursuant to the provisions of Government Code section 66016, in which: (1) the City published notice of the public hearing twice at least 10 days before the 7 date of the hearing; (2) the City sent notice of the meeting at least 14 days in advance to 8 any interested person who had filed a written request; and (3) the City made available to the public at least 10 days before the meeting the data indicating the amount of the 9 estimated costs required to provide the service for which the proposed fees will be levied and the revenue sources anticipated to provide the service, including General Fund 10 revenues. 11 2. All oral and written presentations made to and heard by the City 12 Council during the public hearing for this Resolution were properly considered. 13 3. The cost estimates, including the data upon which the cost estimates are based, which was produced by City staff and considered by the City Council in 14 establishing the fees pursuant to this Resolution, are reasonable cost estimates for the provision of the City services to which the fees pertain and were made available to the 15 public pursuant to Government Code section 66016. 16 4. There is a reasonable relationship between the fees to be collected for 17 the provision of City services described in this Resolution and the City's costs in providing those services, as identified in the data made available to the public. 18 5. The fees for the towing and storage of impounded vehicles shall be as 19 follows: 20 Towing Fee $172.50 21 (For towing services provided by franchise tow vendors) Storage Fee — Standard Vehicles/Motorcycles $35.00/day 22 Storage Fee — Oversized Vehicles $50.00/day 23 Lien Sale Processing Fee $75.00 24 6. The fee amounts set forth in this Resolution do not exceed the actual or estimated reasonable costs to the City of providing the services to which the fees relate, 25 as explained in Exhibit "A," which is attached hereto and incorporated herein by this reference. Those services include, but are not limited to, the following: (1) Towing 26 services provided by the towing companies under franchise agreements with the City; (2) Storage fees for daily storage at the City's impound lot, which fees include maintenance 27 costs, equipment costs and personnel costs; (3) Staff time required for processing of lien 28 sales of vehicles left at the City's impound lot beyond the statutory 30 -day time period. 7.
