1 establish certain fees for towing and storing impounded vehicles, under the Vehicle Code <br />sections cited above as well as under the police power granted to cities by Article XI, <br />2 Section 7 of the California Constitution and pursuant to the provisions of Government Code <br />3 section 66016. <br />4 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />5 <br />1. Notice of the public hearing at which this Resolution was considered <br />6 was properly given pursuant to the provisions of Government Code section 66016, in <br />which: (1) the City published notice of the public hearing twice at least 10 days before the <br />7 date of the hearing; (2) the City sent notice of the meeting at least 14 days in advance to <br />8 any interested person who had filed a written request; and (3) the City made available to <br />the public at least 10 days before the meeting the data indicating the amount of the <br />9 estimated costs required to provide the service for which the proposed fees will be levied <br />and the revenue sources anticipated to provide the service, including General Fund <br />10 revenues. <br />11 2. All oral and written presentations made to and heard by the City <br />12 Council during the public hearing for this Resolution were properly considered. <br />13 3. The cost estimates, including the data upon which the cost estimates <br />are based, which was produced by City staff and considered by the City Council in <br />14 establishing the fees pursuant to this Resolution, are reasonable cost estimates for the <br />provision of the City services to which the fees pertain and were made available to the <br />15 public pursuant to Government Code section 66016. <br />16 4. There is a reasonable relationship between the fees to be collected for <br />17 the provision of City services described in this Resolution and the City's costs in providing <br />those services, as identified in the data made available to the public. <br />18 <br />5. The fees for the towing and storage of impounded vehicles shall be as <br />19 follows: <br />20 Towing Fee $172.50 <br />21 (For towing services provided by franchise tow vendors) <br />Storage Fee — Standard Vehicles/Motorcycles $35.00/day <br />22 Storage Fee — Oversized Vehicles $50.00/day <br />23 Lien Sale Processing Fee $75.00 <br />24 6. The fee amounts set forth in this Resolution do not exceed the actual <br />or estimated reasonable costs to the City of providing the services to which the fees relate, <br />25 as explained in Exhibit "A," which is attached hereto and incorporated herein by this <br />reference. Those services include, but are not limited to, the following: (1) Towing <br />26 services provided by the towing companies under franchise agreements with the City; (2) <br />Storage fees for daily storage at the City's impound lot, which fees include maintenance <br />27 <br />costs, equipment costs and personnel costs; (3) Staff time required for processing of lien <br />28 sales of vehicles left at the City's impound lot beyond the statutory 30 -day time period. <br />7.
