R-160-05 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />UPHOLDING THE PLANNING COMMISSION'S DENIAL OF A REQUEST TO <br />CHANGE THE GENERAL PLAN LAND USE DESIGNATION FROM OPEN <br />SPACE TO LIGHT INDUSTRIAL AND A REQUEST TO CHANGE THE <br />ZONING DESIGNATION FROM OS (OPEN SPACE) TO M-1 (LIGHT <br />INDUSTRIAL) FOR PROPERTY LOCATED SOUTH OF CONGRESS STREET, <br />EAST OF THE UNION PACIFIC RAILROAD (APN 0163-362-26-0000): FILE <br />INDEX NO. DAP -000-284 <br />WHEREAS, David Avina and Isela Gonzales ("Applicants") filed applications (File No. <br />DAP -000-284) requesting a general plan amendment to re -designate property from Open Space <br />to Light Industrial, a zone change from OS (Open Space to M-1 (Light Industrial), A Conditional <br />Use Permit, Architectural/Site Plan Review and Environmental Assessment ("Applications") to <br />permit the establishment and operation of A lumber mill on a 10.5 acre parcel of land located <br />south of Congress Street, east of the Union Pacific Railroad (Assessor Parcel No. 0163-362-26- <br />0000) in the City of Colton, County of San Bernardino ("Subject Site"); and <br />WHEREAS, the City of Colton Planning Commission (the "Planning Commission") held a <br />public hearing on the Applications on September 13 and September 27, 2005 and continued the <br />hearing to October 11 and October 25, 2005, after giving published notice of the Applications; <br />and <br />WHEREAS, on October 25 2005, the Planning Commission, by a vote of 4 to 2, <br />recommended denial of the General Plan Amendment and Zone Change applications and <br />denied the remaining Applications; and <br />WHEREAS, a timely appeal was filed by the Applicants; and <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. The City Council of the City of Colton hereby determines that the proposed <br />Applications are not consistent with the goals and policies of the City of Colton General Plan and <br />are not reasonably related to the public welfare of the citizens of the City and the surrounding <br />region.
