R-88-05 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />RATIFYING THE CITY MANAGER'S DECLARATION OF AN EMERGENCY <br />AND THE ACTIONS HE DEEMED NECESSARY TO REPAIR THE SEWER <br />MAIN ON LA CADENA DRIVE TO 7T" STREET <br />WHEREAS, Section 22050 of the State Public Contract Code governs emergency <br />contracting procedures applicable to the City of Colton; and <br />WHEREAS, Section 22050 of the Public Contract Code allows the Colton City Council <br />to pass a resolution by a four-fifths vote of its membership ratifying the City Manager's <br />determination that (a) emergency conditions exist that do not permit a delay resulting from a <br />competitive solicitation for bids; and (b) the repairs are necessary to respond to the <br />emergency; and <br />WHEREAS, the Colton City Council finds, based upon the Staff Report and other <br />information in the record, that emergency conditions existed on La Cadena Drive to 7th Street <br />between 'L" and `M' Streets, which meet the requirements of Section 22050, and that the City <br />Manager took appropriate action to respond to such emergency. <br />NOW, THEREFORE, BE IT RESOLVED that the Colton Utility Authority resolves as <br />follows: <br />1. The Colton City Council hereby ratifies the City Manager's actions, and approves a <br />change order in an amount not -to -exceed $8,300 to repair the sewer main, pursuant to <br />Section 22050 of the Public Contract Code, to respond to the stated emergency. <br />PASSED, APPROVED and ADOPTED this 19th day of July 2005. <br />HELEN A.
