1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />19 <br />nil <br />21 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, subsequent to the Planning Commission's denial of the appeal of <br />the Application, the Applicant timely appealed the determination to the Colton City <br />Council ("City Council") <br />WHEREAS, on January 17, 2006 the City Council considered the appeal of <br />the Application ; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution <br />have occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />COLTON: <br />SECTION 1. The City Council of the City of Colton hereby denies the appeal <br />of the Application and upholds the decisions of the Design Review Committee and <br />Planning Commission denying the continued placement of a chain link fence on that <br />portion of Assessor Parcel Number 161-061-36 located on Pennsylvania Avenue <br />between Acacia and Laurel Street for the reasons set forth in the record of the <br />proceedings, including the following: <br />(i) allowing the continued placement of a chain link fence on that portion of Assessor <br />Parcel Number 161-061-36 located on Pennsylvania Avenue between Acacia and <br />Laurel Street does not maintain and improve the aesthetics and appearance of the <br />neighborhood; <br />(ii) allowing the continued placement of a chain link fence on that portion of Assessor <br />Parcel Number 161-061-36 located on Pennsylvania Avenue between Acacia and <br />Laurel Street is inconsistent with the Colton General Plan Industrial Principal C-3 <br />policy. <br />SECTION 2. Effective Date. This Resolution shall become effective upon its <br />adoption. <br />PASSED, APPROVED AND ADOPTED this 17th day of <br />off January, 2006. <br />4o 1 ee <br />DEIRDRE .
