R-134-06 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON INCREASING FEES FOR RETURNED <br />CHECKS <br />WHEREAS, under the police power granted by Article XI, Section 7 of the California <br />Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />WHEREAS, in addition tc the authority granted by the State Constitution, <br />Government Code section 66016 provides that a city may establish or increase fees for <br />certain public services by ordinance or resolution; and <br />WHEREAS, the City Council of the City of Colton has determined that in order to <br />continue providing effective service for the public welfare, the City must increase fees for <br />certain municipal services which accurately reflect the: City's true costs in providing such <br />services; and <br />WHEREAS, the City Council previously adopted Resolution No. R-2-88 which <br />established a fee of fifteen dollars ($15) for each check submitted to the City for payment <br />but returned to the City as un -payable due to insufficient funds; and <br />WHEREAS, over the years the City's costs have increased for processing returned <br />checks and the City has borne these additional costs and has not increased the fee for <br />returned checks; and <br />WHEREAS, the City Council has determined that it is no longer cost effective for the <br />City to continue to bear these costs; and <br />WHEREAS, the City Council of tha City c` Cclion has determined that in order to <br />continue providing effective service for t�h public welfare, the City rT'iust increase its fees <br />for processing returned checks to accurately reflect the City's true costs in providing such <br />services; and <br />
