R-148-06 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />PROVIDING DIRECTION TO CITY STAFF CONCERNING THE <br />INTERPRETATION OF CERTAIN PROVISIONS IN CHAPTER 3.08 OF THE <br />COLTON MUNICIPAL CODE (BIDDING CONTRACTING AND PURCHASES) <br />AS THESE ARE APPLICABLE TO NEW SEWER/WATER LINE <br />INSTALLATION PROJECTS <br />WHEREAS, Colton Municipal Code, Section 3.08.020 defines work performed to keep, <br />operate and maintain publicly owned water, power or waste disposal systems not within the <br />definition of "public project"; and <br />WHEREAS, Colton Municipal Code, Section 3.08.020 further provides that sewer <br />maintenance work is not within the definition of "public project"; and <br />WHEREAS, the new City sewer and water pipelines are in the process of being installed <br />in an effort to keep, operate and maintain the City's publicly owned water and sewer system and <br />avoid emergency repairs that disrupt the health, safety; and convenience of the public; and <br />WHEREAS, the scope of installation of sewer and water pipelines on individual streets or <br />related street segments varies depending on the individual street or related street segment due <br />to differences in age, type, quality and placement of the pipeline in the street; and <br />WHEREAS, in order to accommodate these differences and increase the efficiency of <br />such installation, it is necessary to provide City staff with direction concerning the definitions of <br />"work" and "project" to eliminate ambiguities in the application of the City's purchasing <br />regulations and establish that the installation of water and sewer pipelines on individual streets <br />or related street segments are single projects that may be bid and undertaken individually; and <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES RESOLVE AS <br />FOLLOWS: <br />SECTION 1. For purposes of determining what constitutes a "work" or "project" <br />for purposes of determining the applicable provisions of Section 3.08.060, the City Council <br />hereby directs staff to interpret the City's purchasing rules to provide that the installation of new <br />water and sewer pipelines on individual streets or related street segments are single projects <br />that may be bid and undertaken individually. <br />-1- <br />
