An established residential neighborhood is located to the <br />west of the Subject Site. Persons accessing the Project will necessarily have to use <br />streets that run through this residential neighborhood. City Staff estimates, based on <br />the ITE Manual that up to 74 peak hour trips could be generated by the Project. This <br />increased traffic through a residential neighborhood creates a safety hazard for <br />children who reside in the neighborhood, and for other persons who may walk or <br />ride bicycles in the neighborhood. Further, the traffic and noise that may be <br />associated with the Project would detract from the harmony of the neighborhood, <br />and may lead to blighting conditions. <br />2. General Objective No. 2 of the Land Use Element provides that it <br />is a general objective of the City of Colton to: provide a compatible mix and arrangement <br />of land uses and to promote future development in a manner consistent with the availability <br />of infrastructure. (pp. 2-12) <br />a. The Subject Site is designated under the Specific Plan for <br />the West Valley (East Subarea) with a land use designation of "Mixed Use'. While <br />the Project is consistent with the land use designation, the Specific Plan Goals <br />provide that development should: prescribe compatible uses adjacent to existing <br />residential areas. " A nightclub/ entertainment center with on-site alcohol <br />consumption is not a use that is compatible with the adjacent residential <br />neighborhood, especially considering that traffic generated by customers accessing <br />the Project will necessarily flow through this residential neighborhood. <br />SECTION 4. Based on the entire record before the City Council and all <br />written and oral evidence presented, and the findings made in this Resolution, the <br />City Council hereby finds that the Application does not comply with the zoning <br />regulations set forth in Title 18 of the City of Colton Municipal Code (the "Zoning <br />Code"). <br />A. Section 18.58.060(H) (2) of the City of Colton Municipal Code <br />provides that in order to grant a CUP, the City Council must find that: The proposed <br />use, together with the conditions applicable thereto will not be detrimental to the public <br />health, safety or welfare, or materially injurious to properties or improvements in the vicinity. <br />1. Professional advice of City Staff, public comment from <br />the residents of the adjacent residential neighborhood and a review of the traffic <br />patterns that will result from development of the Project all indicate that the on-site <br />-8- <br />
