The City's Police Department opposes the Project because the <br />Department believes that a nightclub serving alcohol is not an appropriate use near a <br />residential neighborhood. Based on the Police Department's experience, similarly situated <br />uses have resulted in an increase in assaults, disturbances of the peace, fighting, public <br />urination, an increase in drunk driving, and an increase in night-time traffic. Section 18.58.030(a) of the City of Colton Municipal Code <br />provides that the City Council is to deny site plans and elevations for a proposed <br />development if they make one or more of the following findings: <br />1 Section 18.58.030(a) The provisions for vehicular parking and <br />for vehicular pedestrian circulation on the site, and onto adjacent public right-of-way will <br />create safety hazards. <br />• As described in the Recitals set forth herein, the Application <br />does not comply with the minimum parking requirements set <br />forth in the Zoning Code, even with approval of a Minor <br />Variance. The lack of adequate parking spaces, as required by <br />the Zoning Code, will create safety hazards in terms of vehicular <br />and pedestrian circulation, and vehicular parking on the Subject <br />Site. <br />C. Based on the City's application of the Zoning Code, as described <br />in the Recitals set forth herein, the Application does not provide the minimum <br />number of parking spaces required by the Zoning Code. <br />1. As described in the Recitals set forth herein, the minimum <br />number of parking spaces required for approval of the Application, without a major <br />variance, is no less than 139 parking spaces, including five (5) handicapped spaces. <br />The Application proposes to provide 111 parking spaces, with two (2) handicapped <br />spaces. <br />Resolution. <br />SECTION 5. The City Clerk shall certify to the adoption of this <br />
