I RESOLUTION NO. R-39-06 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 COLTON, CALIFORNIA TO VACATE A PORTION OF THE ALLEYWAY LOCATED WEST OF 5T" STREET, EAST OF 4T" STREET, BETWEEN 4 'N' STREET AND 'O' STREET, PURSUANT TO CALIFORNIA 5 STREETS AND HIGHWAYS CODE SECTION 8330 ET SEQ. 6 WHEREAS, the California Streets and Highways Code provides that a street or 7 highway, including an alley or alleyway, may be summarily vacated if certain conditions are 8 met; and 9 10 WHEREAS, the City has received a request from property owner Aurora Marentez to 11 summarily vacate a portion of the alleyway located west of 5th Street, east of 4`h Street, 12 between N Street and O Street, which was created by the recordation of the Map of the Town 13 of Colton in 1887; and 14 WHEREAS, the specific portion of the alleyway described herein has been 15 impassable to vehicular and pedestrian travel for the past five (5) years due to a change in 16 elevation of eight (8) feet, which portion is located approximately one hundred (100) feet west 17 of 5`h Street. 18 WHEREAS, no public improvements have been made to, or public money spent on, 19 the portion of the alleyway described herein for the past five (5) years.; and 20 WHEREAS, this summary vacation is made pursuant to the California Streets and 21 22 Highways Code, Division 9, Part 3 (sections 8300 et seq.), Chapter 4 — Summary Vacation. 23 WHEREAS, all other legal prerequisites to the adoption of this Resolution have 24 occurred. 25 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES 26 HEREBY RESOLVE AS FOLLOWS: 27 SECTION 1. Incorporation of Recitals. The City Council hereby finds and determines 28 that the recitals of this Resolution are true and correct and are hereby incorporated into this Resolution.
