I <br />RESOLUTION NO. R-39-06 <br />2 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />3 COLTON, CALIFORNIA TO VACATE A PORTION OF THE ALLEYWAY <br />LOCATED WEST OF 5T" STREET, EAST OF 4T" STREET, BETWEEN <br />4 'N' STREET AND 'O' STREET, PURSUANT TO CALIFORNIA <br />5 STREETS AND HIGHWAYS CODE SECTION 8330 ET SEQ. <br />6 <br />WHEREAS, the California Streets and Highways Code provides that a street or <br />7 <br />highway, including an alley or alleyway, may be summarily vacated if certain conditions are <br />8 <br />met; and <br />9 <br />10 WHEREAS, the City has received a request from property owner Aurora Marentez to <br />11 summarily vacate a portion of the alleyway located west of 5th Street, east of 4`h Street, <br />12 between N Street and O Street, which was created by the recordation of the Map of the Town <br />13 of Colton in 1887; and <br />14 WHEREAS, the specific portion of the alleyway described herein has been <br />15 impassable to vehicular and pedestrian travel for the past five (5) years due to a change in <br />16 elevation of eight (8) feet, which portion is located approximately one hundred (100) feet west <br />17 of 5`h Street. <br />18 <br />WHEREAS, no public improvements have been made to, or public money spent on, <br />19 <br />the portion of the alleyway described herein for the past five (5) years.; and <br />20 <br />WHEREAS, this summary vacation is made pursuant to the California Streets and <br />21 <br />22 Highways Code, Division 9, Part 3 (sections 8300 et seq.), Chapter 4 — Summary Vacation. <br />23 WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />24 occurred. <br />25 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />26 HEREBY RESOLVE AS FOLLOWS: <br />27 SECTION 1. Incorporation of Recitals. The City Council hereby finds and determines <br />28 <br />that the recitals of this Resolution are true and correct and are hereby incorporated into this <br />Resolution. <br />
