1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Applications in order to perform additional CEQA review, consistent with the Court's decision <br />with respect to these three specific issue areas; and <br />WHEREAS, following the Court's decision, the City prepared a Revised Draft <br />Environmental Impact Report ("Revised DEIR") to address the three specific areas which the <br />Court found to be incomplete, which has been duly considered and is described in further detail <br />in Planning Commission Resolution Certifying the Revised Final Environmental Impact Report <br />for the Pacific Rail Metal Shredding Operation Project, Adopting Environmental Findings <br />Pursuant to the California Environmental Quality Act and a Mitigation Monitoring Program, and <br />Approval of the Pacific Rail Metal Shredding Operation Project (Planning Commission Resolution <br />No. R-04-06), and in the proposed City Council Resolution Rejecting an Appeal by Colton Iron & <br />Metal to Set Aside the Planning Commission's Certification of the Revised Final Environmental <br />Impact Report Prepared for the Pacific Rail Metal Shredding Operation Project, Confirming <br />Certification of the Revised Final Environmental Impact Report, Adopting Environmental Findings <br />and a Mitigation Monitoring Program Pursuant to the California Environmental Quality Act, and <br />Approving the Pacific Rail Metal Shredding Operation Project; and <br />WHEREAS, the Applications were referred to all affected public agencies for <br />review and consideration; and <br />WHEREAS, the Applications were reviewed, studied, and found to be consistent <br />with the City's adopted General Plan; and <br />WHEREAS, on June 13, 2006, the Planning Commission conducted a duly <br />noticed public hearing on the Applications, including the Revised Final EIR, at which time all <br />persons wishing to testify in connection with the Applications were heard; and <br />WHEREAS, at the June 13, 2006 Planning Commission meeting, the Planning <br />Commission adopted Resolution No. 05-06 approving the Applications; and <br />-3- <br />
