1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City and the Agency desire that the Funding and Construction Management Agreement be amended to add Curbs, Gutter and Sidewalk Acacia Street l Improvements and Landscaping Improvements at Mill St. & Rancho Ave and "C" St. and Rancho Ave., and to provide that these projects be financed with Rancho Mill Funds. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY RESOLVE AND FIND AS FOLLOWS: Section 1. The recitals set forth above are true and correct. Section 2. The City Council hereby approves Amendment No. 1 to the Funding and Construction Management Agreement on file with the City Clerk. Section 3. Except as amended by Amendment No. 1, the Funding and Construction Management Agreement is in all respects confirmed and all of the terms, provisions and conditions thereof shall be and remain in full force and effect. Section 4. The City Manager is hereby authorized and directed to execute Amendment No. 1 on behalf of the City, together with such technical and conforming changes to the text of Amendment No. 1 as may be recommended by the City Attorney, so as to conform the text to the specific public works construction and management responsibilities assumed by the City under the Funding and Construction Management Agreement, as amended by Amendment No. 1. The City Manager and the City Engineer are hereby authorized and directed to administer the responsibilities of the City assumed under the Funding Construction Management Agreement, as amended by Amendment No. 1.
