Except as amended by Amendment No. 2, the Funding and <br />,onstruction Management Agreement is in all respects confirmed and all of the terms, <br />provisions and conditions thereof shall be and remain in full force and effect. <br />Section 4. The City Manager is hereby authorized and directed to execute <br />Amendment No. 2 on behalf of the City, together with such technical and conforming changes <br />to the text of Amendment No. 2 as may be recommended by the City Attorney, so as to <br />conform the text to the specific public works construction and management responsibilities <br />assumed by the City under the Funding and Construction Management Agreement, as <br />amended by Amendment No. 2. The City Manager is hereby authorized and directed to <br />administer the responsibilities of the City assumed under the Funding Construction <br />Management Agreement, as amended by Amendment No. 2. <br />Section 5. As necessary, the City Manager and Executive Director is <br />authorized to make further adjustments which may extend the timelines or reallocate funds <br />among the projects previously approved by the City Council and Executive Director. <br />Section 6.
