R-41-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, APPROVING AMENDMENT NO. 2 TO RANCHO MILL CONSTRUCTION MANAGEMENT AGREEMENT WHEREAS, the Redevelopment Agency for the City of Colton (the "Agency") may, with consent of the City Council of the City of Colton (the "City"), pay for all or a part of the cost of the installation and construction of any building, facility, structure or other improvement that is publicly owned either within or outside of the Rancho Mill Redevelopment Project Area (the "Project Area") pursuant to Health and Safety Code Section 33445; and WHEREAS, the Agency obtained a loan of $500,000 from the City of Colton (the "City") pursuant to that certain Redevelopment Agency Promissory Note, dated as of September 16, 2003. The Agency may use and apply the proceeds of such loan for any of the purposes authorized under Section 2 that certain Rancho Mill Public Works Projects Funding and Construction Management Agreement, dated as of April 6, 2004, including for paying the cost of the installation and construction of buildings, facilities, structures or other improvements that are publicly owned and situated within or of benefit to the Rancho Mill Redevelopment Project Area; and WHEREAS, the City and the Agency entered into that certain Rancho Mill Public Works Projects Funding and Construction Management Agreement, dated as of April 6, 2004, and Amendment No. 1 to Rancho Mill Public Works Project Funding and Construction Management Agreement, dated as of July 18, 2006, (the "Funding and Construction Management Agreement') for the City to provide construction management services to the Agency for the projects specified in Section 2 of such agreement; and WHEREAS, as of the date hereof, certain of the public work improvement projects described in Section 2 of Rancho Mill Construction Management Agreement have not been completed; and
