9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, there are no other in-place public utility facilities that are in use and would be <br />affected by the vacation; and <br />WHEREAS, the City of Colton has no use for the Portion of `K' Street; and <br />WHEREAS, Section 8313(b) of the Streets and Highways Code and Section 65402 of the <br />Government Code requires that any proposed vacation be reviewed for conformity with the City's <br />General Plan; and <br />WHEREAS, in compliance with the above referenced statutes, the Planning Commission will <br />evaluate the proposed vacation of the Portion of'K' Street at a regularly scheduled meeting on April <br />24, 2007 and will report its findings to the City Council. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />1. Declaration of Intent. The City Council declares its intent to vacate that <br />portion of the public right-of-way known as `K' Street, south of the Southern Pacific Railroad tracks, <br />between 7t" Street and La Cadena Drive, measuring approximately eighty (80) feet wide and three <br />hundred seventy (370) feet long and more fully described and depicted in Exhibit "A" attached <br />I hereto. <br />2. Hearing. The City Council, under the authority vested in it by Streets and <br />Highways Code Section 8320(a)(1), hereby directs the City Clerk to: (1) set the date of the public <br />hearing as May 15,2007 for the City Council to hear and consider the proposed vacation of the <br />Portion of 'K' Street ; and (2) publish and post the notices required thereunder. <br />3.
