required by the HEMP that have already been completed. This bond shall last a maximum of ten (10) years. PROVIDED, that any alterations in the Work to be done or the materials to be furnished, or changes in the time of completion, which may be made pursuant to the terms of Section 5.1 of the Agreement, shall not in any way release said Principal or said Surety hereunder, nor shall any extensions of time granted under the provisions of said Agreement, release either said Principal or said Surety, and notice of such alterations or extensions of the Agreement is hereby waived by said Surety. The Surety will give prompt notice to the Principal and the [USFWS designee] of any notice received or action filed alleging the bankruptcy or insolvency of the Surety, or alleging any violations or regulatory requirements which could result in suspension of revocation of the Surety's license to do business. In the event that the Surety becomes unable to fulfill its obligations under the bond for any reason, notice shall be given immediately to the Principal and to the [USFWS designee].
