Exhibit H <br />Credit Evaluation <br />(or proportionate credit formula) <br />The Colton Habitat Conservation Bank will be composed of 150 acres, which involves 160 <br />acres with a ten acre deduction for various easements. The Habitat Conservation Bank will <br />be awarded 150 Conservation Credits, one credit per acre. This award of mitigation credits <br />assumes that all provisions of the Agreement will be implemented, in particular, the <br />following: <br />• Vulcan will place Conservation Easements over lands within the boundaries of the <br />Colton Mitigation Bank as follows: (1) on the entire Property on which Conservation <br />Credits are awarded (Option 1); or (2) in phases, beginning with an initial phase of at <br />least sixty acres (Option 2), and where each subsequent phase may be no less than ten <br />(10) acres. See the attached 15 phases designated as Mitigation Bank Tracts A <br />through O. <br />• Vulcan will initiate implementation of the HEMP, attached to the Agreement as <br />Exhibit F. <br />• Vulcan will purchase the Conservation and Endowment Bonds, in a form as attached <br />to the Agreement as Exhibit G and Exhibit M, respectively. <br />
