broker familiar with the Service Area plus a percent over that amount estimated to cover changes <br />in costs of land through August 31, 2008. <br />2.0. ESTABLISHMENT AND DEVELOPMENT OF CONSERVATION BANK <br />2.1. The Conservation Bank shall be deemed established when: <br />(a) Owner provides the USFWS with general and site location maps (Exhibit A), <br />a legal parcel map (Exhibit B), legal description (Exhibit C), and title report (Exhibit D) for the <br />Property, describing Owner's interest in the Property and documenting any encumbrances (other <br />than monetary encumbrances, which must be subordinated or removed), easements, restrictions, <br />or other matters affecting the property. <br />(b) The Parties agree to a Conservation Easement or other suitable title restriction <br />on the Property in the County where the Property is located consistent with Section 3 of this <br />Agreement, attached hereto as Exhibit L <br />(c) Owner and the USFWS agree that the "Property Assessment" identifies 150 <br />acres on the Property, which would ultimately, at bank completion, be burdened by Conservation <br />Easement(s) for conservation purposes in accordance with this Agreement, to occur in ten acre <br />phases. <br />(d) Owner provides the USFWS with a Phase I Environmental Contaminants <br />Survey for the Property subject to USFWS approval, attached hereto as Exhibit P <br />(e) The Parties agree to incorporate into this Agreement the HEMP, attached <br />hereto as Exhibit F, in accordance with this Agreement. <br />(f) Owner provides the USFWS a copy of the Conservation Bond and Endowment <br />Bond consistent with Exhibit G and Exhibit M, respectively- <br />05/19/2005 <br />espectively.05/19/2005 - 10 <br />
