R E C I T A L S• A. Grantor is the owner of the certain real property described.in Exhibit "A" ("Grantor Property"). B. Grantee desires to obtain rights to develop a well for domestic and irrigation water A suitable location for the well is that portion of the Grantor Property described in Exhibit "B" ("Well Site"). A suitable area for the underground installation and maintenance of pipelines and utility lines appurtenant to the well is that portion of the Grantor. Property described in Exhibit "C" ("Easement Area"). The Well Site and Easement Area a,re shown on the map attached hereto as`Exhibit "D". C,. Grantor desires to grant. and Grantee desires to obtain title to the Well Site and an easement over the Easement Area for the purposes and upon the terms and conditions contained herein. WHEREAS, the parties hereto agree as follows: 1. Grant Deed to Well Site. Concurrently with the execution of this Agreement, Grantor has executed a grant deed in favor of Grantee covering the Well Site. ("Grant Deed"), subject to the covenants, conditions and restrictions contained herein. 2. Easement to Easement Area.
