Y <br />AGREEMENT <br />FOR THE CONSTRUCTION OF <br />LA CADENA DRIVE UNDERGROUND ELECTRICAL SYSTEM <br />(STREET LIGHT) JOB NO. 88-02 <br />THIS AGREEMENT is made and entered into this 2nd day of <br />December 1988, by and between <br />ART A O TATE INC <br />(hereinafter referred to as the "Contractor"') and the <br />CITY OF COLTON <br />State of California, (hereinafter referred to as the "City") <br />R E C I T A L S <br />WHEREAS, the City, by Resolution approved and adopted, duly awarded the <br />Contract to the Contractor, and for further particulars reference is hereby <br />made to the records of the proceedings on file in the Office of the City <br />Clerk and open to public inspection; and <br />WHEREAS, said works of improvement for which the Contractor was awarded the <br />Contract are set forth herein. <br />NOW, THEREFORE, IT IS MUTUALLY AGREED BY THE PARTIES HERETO AS FOLLOWS: <br />A G R E E M E N T <br />1. That the Contractor, for the consideration hereinafter mentioned, will <br />do and perform in good and workmanlike manner, all the hereinafter mentioned <br />work or improvements, under the direction and to the satisfaction of the <br />City all the Mork to be done under contract in accordance with the.plans, <br />specifications and drawings. <br />2. That the following is a'general and abbreviated description of the works <br />of improvement: <br />LA CADENA DRIVE UNDERGROUND ELECTRICAL SYSTEM <br />3. That the Contractor will, at said Contractor's own cost and expense, <br />furnish all necessary materials and labor for said work, and the materials <br />used therein shall comply with the specifications and be to the satisfaction <br />of the City, AND, the Contractor will, within 60 calendar days from the date <br />hereof, complete the said work or improvements and turn same over to the <br />City ready for use and free and discharged of all liens, claims and demands' <br />whatsoever. The provisions of Title 1 (Commencing with Section 4200), <br />Chapter 3, Division 5 of the Government Code of the State of California, and <br />further, the provisions of Title 155 (Commencing with Section 3082), Part 4, <br />Division 3 of the Civil Code of the State of California, are expressly made <br />applicable to work done ,under this Agreement. <br />AGREEMENT'PAGE 1 <br />
