Notwithstanding any requirement to the contrary in the <br />original Agreement between City and Subdivider, Subdivider need not <br />complete the installation of the remaining landscaping improvements <br />required by City in said original Agreement prior to building <br />occupancy in said Tract No. 12637 and then only along that lot upon <br />which the occupied building is located and along that portion of any <br />public right-of-way abutting and adjacent to such lot. <br />I <br />3. City hereby consents to a $200,000 reduction of the <br />set-aside letter from Subdivider's lender and a modification o the <br />terms .of the set-aside letter so that it no longer secures the <br />installation of the landscaping portion of the Improvementork. <br />4. The date upon which Subdivider shall be obligat d to <br />complete all. Improvement Work other than landscaping �shal be <br />extended by one (1) year to the first anniversary of the deadline for <br />the completion of such work set forth in said original Agreement <br />5.
