Keane, Assistant City Manager; <br />SUBJECT: ADOPTION OF AN ORDINANCE MODIFYING THE Date: 9/13/88 <br />CITY'S CABLE TELEVISION FRANCHISE ,il <br />In October 1986, the City Council authorized the transfer of the <br />existing cable television franchise to.American Cable TV Investors <br />IV, Ltd. This transfer was contingent on the successful negotiation <br />of a number of performance deficiencies on the part of the prior <br />owners. As,Councol is aware, we have recently completed this process <br />and have agreed to a resolution of all of the disputed issues. <br />Based on direction.from`the Council, the Mayor has signed a "settle- <br />ment agreement" with the cable company which provides the following: <br />1. Increase in franchise fees to be received by the City from <br />3% to 4%. <br />2. Payment of $89,998 to the City for thelpurchase of cable equip- <br />ment, in lieu of the provision of a cable television studio. <br />3. Activation of a return path from City Hall which will enable <br />the -City to broadcast programming on a local channel. <br />4. Limited access to the cable company's mobile van for special <br />program taping and editing services. <br />5. Revisions to existing franchise language regarding rate <br />regulation and must -carry channels to ring it in conformance <br />with current state and federal legislation. <br />Since the initial franchise was.adopted byllordinance, the City <br />must also formally enact the above provisions by ordinance. <br />RECOMMENDATION: <br />Staff recommends that the Council waive full reading and approve <br />for first reading Ordinance 0-28-88 by tittle as follows: <br />AN ORDINANCE OF, THE CITY COUNCIL OF THE CITY <br />OF COLTON AMENDING ORDINANCE NO. 1578 AND <br />APPROVING AN AGREEMENT ENTITLED "`SETTLEMENT <br />AGREEMENT"r DATED AUGUST 26, 1988 AND INCORPORATING <br />SAID AGREEMENT INTO ORDINANCE NO 1578 AND AMENDING <br />CHAPTER 5.06 OF THE COLTON MUNICIPAL CODE <br />PURUSANT TO SAID SETTLEMENT AGREEMENT <br />Attachments: <br />City Manager Concurrence: <br />Rage 1 ofd__ <br />Item No. OP <br />
