CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of February 7, 1989 <br />TO: Honorable Mayor and City Council <br />FROM: John C. Hutton, Director of Public Works <br />j�l <br />SUBJECT: Tree Trimming Contract Services, <br />Approval to Waive Bond Requirements <br />Date: January 30, 1989 <br />Recently the Purchasing Department sent out the approved tree trimming contract for <br />FY88-89 to 16 tree trimming firms. The bid packets were mailed on January 10, with a <br />bid opening set for January 23, however, no bids were received. <br />The contractors who were contacted informed the City that the reason for not submitting <br />bids was the performance bond requirements. Staff has reviewed the need to require per- <br />formance bonds on this small service-oriented contract since payment is made only after <br />satisfactory completion of the work. <br />The State Public Contract Code, Section 20166, specifies that if no bids are received <br />for a public works project, a legislative body may have the project constructed with <br />no further compliance with the Code.
