B. Land Use Designation For Hazardous Waste Facilities I <br />The CHWMP shall amend the Development Code (or Zoning Ordi- <br />nance) to require all specified hazardous waste facilities to <br />be permitted only with an approved Site Approval (Conditional <br />Use Permit) in areas with a zoning overlay of Specified <br />Hazardous Waste Facility. The purpose of the overlay is to <br />ensure that facilities are sited in areas that protect public <br />health. safety, welfare, and the environment; to assign the <br />overlay to the project site and buffer so that incompatible <br />uses cannot be permitted in the future; to identify permitted <br />uses of the overlay; and to outline the permit review proce- <br />dures. <br />C. Siting Criteria <br />State law requires the CHWMP to include siting criteria and <br />designate general areas where the criteria might apply. The <br />siting criteria will represent a uniform set of standards <br />applied to all applications. vet they are designed with some <br />flexibility depending on the type of facility and the pro- <br />posed site location. Table 5-2 on the following page is a <br />summary of the recommended siting criteria. An applicant for <br />a specified hazardous waste faculty must demonstrate con- <br />sistency with the siting criteria and the policies of this <br />plan in order to receive approval of a soeclfieo nazaraous <br />waste facility application. <br />0. The Locai Application Review Process <br />State law identifies a formal administrative process for the <br />local review of facility applications. At least 90 days <br />Prior to filing an application for approval of a "specified <br />hazardous waste facility" (an offsite facility serving more <br />than one producer of hazardous waste), the applicant must <br />file with the Office of Permit Assistance (OPA) and the <br />appropriate City of County a Notice of Intent (NOI) to *ile <br />an application. If the project is located within a City. <br />that City must then provide specified pubilc notice or the <br />Notice of Intent. Within 90 days after the NOI is filed, the <br />OPA must convene a public meeting in the affected city to <br />inform the public about the proposed project and the proce- <br />dures that will apply to processinq the application. <br />Within the same time frame. the City Council must appoint a <br />Local Assessment Committee containing representatives of the <br />general public. environmental grouos. and affected business- <br />es. The Local Assessment Committee can neqotiate with the <br />applicant on the details of the project and on conditions for <br />Project approval which would be acceotable to the community. <br />This committee will serve as an advisory body to the City <br />Council. and the City must provide staff resources to assist <br />the Local Assessment Committee. The City may establish a fee <br />to be paid by the applicant for hirino independent consult- <br />ants to review the project and report to the Local <br />3 <br />
