CITE' OF COLTON <br />INTEROFFICE MEMORANDUM <br />70: Honorable Mayor and City Councii DATE: October 19, 1990 <br />FILE ?NUMBER: <br />FROM: Edmund F. Sotelo, City Manager <br />SUBJECT: Hutton/Luque Community Center Expansion Project, <br />Proposal for Services and Materials in lieu of <br />Liquidated Damages. <br />Please find attached a proposal for your consideration by <br />Staff to have additional ammenities included in the above <br />listed project in lieu of the accrued liquidated damages. <br />At present, the contractually stipulated time has expired <br />(9/25/90) and, per contract conditions, the contractor is <br />being assessed $500.00 per day in liquidated damages. These <br />monies are to be withheld from the project retainage. <br />If the liquidated damages accrue to a substantial amount, <br />it could be anticipated that the contractor would contest <br />the liquidated damages' size and extent. <br />This proposal, if accepted through negotiation with the <br />contractor, would assure an additional $12,000± (est.) value <br />to the project, and the contractor would in effect waive any <br />potential claim to the liquidated damages. <br />Please advise if this proposal should be pursued through <br />negotiation. <br />DT/rg <br />Attachments <br />cc: Steve Edwards, Citv Attorney <br />
