The City once again compromised and allowed the Payless Shoe <br />Store request with the understanding that no further <br />compromises would be allowed,.and that should Payless leave <br />the Center, any new tenant would be required to adhere to the <br />limited sign criteria. <br />On or about July 24, 1989, the Round Table Pizza Restaurant <br />submitted plans for their sign. The plans were routinely <br />scrutinized and approved with the condition that their logo <br />be in the allowed colors of blue, black, white, or red. They <br />agreed and the sign was erected with those colors. Some time <br />after the staff signed off on the installation, the Round <br />Table management decided to violate their approved sign and <br />they instructed their sign company to change the colors of <br />the logos to their standard multi -colored shields. <br />On October 3. 19891, Staff issued a correction notice to the <br />owner after repeated verbal attempts to have them conform to <br />the City regulations had failed. Due to the company's <br />failure to respond, Staff issued Citation #0015 on November <br />13$ 1989 to Marvena Sue Meaney (partner). <br />A court date has been set for February 14, 1990 as a pretrial <br />meeting with the City and the representative of the <br />restaurant., Mr. Roy Collier. <br />Analvsis: <br />It is self evident that Round Table Pizza originally knew of <br />the sign criteria and, of their own accord, decided to comply <br />with it. <br />It is also self evident that the Round Table Pizza owners <br />blatantly decided to violate their approval and install their <br />illegal signs. <br />It should be noted that all other tenants have complied with <br />the pre -established sign program, including two businesses <br />which installed nonapproved signs and were forced to remove <br />them and install the correct type of signs. <br />The sign program has been successful in keeping the shopping <br />center orderly, neat and free of gaudy signage. <br />Recommendation: - <br />Staff recommends that the City Council uphold the existing <br />sign program and deny the applicant's request. <br />City Manager Concurrence <br />N <br />
