Sotelo, City Manager 't�lw SUBJECT: Waiver of Formal Bid Process, Awarding of Date: July 10, 1990 Contract for Seismic Retrofit for Veterans Park Racquetball Court BACKGROUND Due to local residents complaints of a large crack in the center wall of the Veterans Park racquetball court, Staff had engaged a structural engineer to re -design a new center wall for replacement. In the course of design and structural analysis, it was found that in its present state, the structure could be subject to failure in an earthquake. Upon discovery of the potential hazard Jerry Young, then Acting City Manager , recommended temporarily fencing off the site and posting warning signs until such time as the retrofit was completed. The Parks Department installed the fencing and signs which have been repeatedly torn down by vandals. The Structural Engineer completed the plans and specifications for the project and the Building Department has reviewed the plans and approved them. Staff has, through an Request For Proposal process, received five (5) proposals to perform the re -construction and retrofit. STATEMENT OF THE PROBLEM To mitigate the potential hazard at the site, the City Council needs to waive the formal bid process as allowed by the Code for emergencies and award the contract to Vail Masonry, whom has submitted the lowest proposal to perform the work.
