<br />The municipal fine and forfeiture lawsuit against San Bernardino County was
<br />filed on February 16, 1988. Sacramento Superior Court issued a partial summary
<br />judgement on July 14, 1989; simply, the court ruled in favor of the cities but
<br />could not determine the dollar amount owed to the cities.
<br />As of April 30, 1990, the City of Victorville has paid legal expenses amounting
<br />to $44,639.73 to Meyers, Nave, Riback & West. Upon execution of the Joint
<br />Exercise of Power Agreement, each party was to submit to the City of Victorville
<br />its appropriate share of the first year's estimated legal expenses of $50,000.
<br />Enclosed is a billing for your city's share of the $50,000.
<br />After several meetings, the Committee has decided to hire a consultant to
<br />determine the amount owed to the cities, and is in the process of selecting a
<br />firm. Anticipating that the County may be opposed to funding the entire cost
<br />of a consultant, the Committee agreed that the cities would likely be willing
<br />to share the cost of a consultant. Further, it is estimated that the additional
<br />legal expenses above $50,000 to Meyers, Nave, Riback, & West will be $25,000.
<br />As expenses exceed $50,000, the City of Victorville shall bill each participant
<br />their appropriate share on a quarterly basis.
<br />Please remit payment for your share of the initial $50,000. If your city should
<br />require more than three weeks to process payment or believe this billing to be
<br />in error, please contact Tanya Mauldin at 619-245-3411, extension 343.
