AGREEMENT <br />FOR THF <br />MUNICIPAL PARD: FENCE <br />THIS AGREEMENT is made and entered into this day of <br />1989, by and between <br />ALCORN FENCE COMPANY <br />(hereinafter referred to as the "Contractor") and th, <br />CITY OF COLTON <br />State of California, (hereinafter referred to as the "Cite). <br />R F C I T A L S <br />WHEREAS, the City Council duly awarded the contract to the <br />Contractor, records of which are on file in the Office of the <br />Cite Cleric and open to public inspection; and, <br />WHEREAS, said works of imt>r•ovement for which the Cont ractcr <br />was awarded the Contractare set forth herein. <br />NOW, THEREFORE, IT IS Mt'TUAL,LY ?,GREED BY THE PARTIES HERETO <br />AS FOLLOWS: <br />A G R E E M E N T <br />That the Contractor, for consideration mentioned in tris <br />proposal, will do in good and workmanlike manner, all the <br />hereinafter mentioned work or improvements under the <br />direction and to the satisfaction of the City. <br />That the following is a general and abbreviated description <br />of the work: <br />"The construction of fencing at Municipal Park, 660 <br />Colton Avenue, Colton, California, and all appurtenant <br />work in connection therewith." <br />That the Contractor will, at said Contractor's own cost and <br />expense, furnish all necessary materials and labor for said <br />work, and the materials used therein shall comply with the <br />specifications and be to the satisfaction of the City, AND, <br />the Contractor will, within Thirty (30) calendar days hereof, <br />complete the said work of improvements and turn same over to <br />the City ready for use and free and discharged of all liens, <br />claims and demands whatsoever. The provisijons of Title 1 <br />(Commencing with Section 4200), Chapter 3, Division 5 of the <br />Government Code of the State of California, and further, the <br />provisions of Title 15 (Commencing with Section 3082), Part <br />AGREEMENT <br />Page 1 <br />
