CITY OF COLTON <br />AGENDA REPORT (CONTINUED) <br />FOR COUNCIL MEETING OF— December 3, 1991 <br />SUBJECT: <br />Councilmanic Districts <br />DISCUSSION• <br />Staff has met several times with representatives of the <br />"Committee"; that group has designated three members to sit on a <br />district boundary review task force, and the City has engaged the <br />firm of National Demographics Corporation (NDC) to provide <br />technical expertise necessary to establish district boundaries. We <br />anticipate a task force meeting with NDC to discuss the process on <br />December 5, 1991. We hope to complete the process of identifying <br />boundaries in mid-December. <br />State law requires that the Council take some action on the <br />"Committee" petition on December 3, 1991. If you refuse to place <br />the initiative ordinance on the ballot, as recommended by staff, <br />the "Committee" will have 30 days to seek legal review. We expect <br />that the process to complete the boundary description will be <br />completed prior to the expiration of this period and that you will <br />have an legally sufficient alternative ordinance to place before <br />the voters. <br />Rather than schedule an election on this matter immediately <br />(February), we are suggesting that Council wait until the regular <br />June election. This will still be a special election for the City <br />but we will be able to consolidate with other agencies who schedule <br />their regular elections at this time. The Elections Code specifies <br />a process which must be followed to call a special election. It is <br />not possible to implement that process at this time for a June <br />election; we need to wait until February. Staff and legal counsel <br />believe, however, that the Council can adopt a resolution of <br />intention to proceed with a June election on this issue; such a <br />resolution is proposed for your adoption. <br />Finally, at the November 19, 1991 Council meeting, you selected <br />representatives to the boundary task force. Our legal counsel has <br />reviewed this process and is suggesting that you ratify your <br />decision at your December 3rd meeting. You may, at that time, also <br />consider alternative names for the task force. <br />FISCAL IMPACT• <br />The cost for technical assistance in the boundary formation process <br />is approximately $14,000; the City has committed $12,000 to this <br />project, with the balance to be assumed by the Committee. The cost <br />for a special election in June is estimated to be $15,000. <br />Page 2 of 3 Item No <br />
