For Council Meeting of February 5,1 991 <br />TO: Honorable Mayor and City Council <br />FROM: Edmund F. Sotelo, City Manager <br />SUBJECT: Veteran's Park Racquetball Court Seismic Date: January 30, 1991 <br />Retrofit Final and Filing of Notice of <br />Completion. <br />BACKGROUND <br />In July of 1990, the Council waived the formal bid process and <br />directed Staff to proceed with the Veteran's Park racquetball court <br />seismic retrofit to eliminate the potential hazard of structural <br />failure during an earthquake. <br />The selection of the contractor was conducted through a request <br />for proposal process. Council directed Staff to award the project <br />to Vail Masonry, Ince with a contingency_to award the project to <br />the next lowest proposal if Vail Masonry could not provide the <br />necessary bonds and insurance. Vail Masonry was unable to provide <br />the performance bond and the project was therefore, awarded to Wyatt <br />Construction. <br />All work to be performed by Agreement and Change Order was completed <br />and accepted by the Building and Safety Department on October 30, <br />1990. Per agreement, the project was left open to allow the con- <br />tractor to research and submit a cost to provide the center walls <br />with plaster finish. Upon submission of the estimate, Staff found <br />the price excessive and advised the contractor that the project <br />would be finalized. <br />STATEMENT OF THE PROBLEM <br />The City Council needs to accept the project work as final and <br />direct Staff to file the Notice of Completion and to release the <br />retention to Wyatt Construction after the 35 day waiting period. <br />ALTERNATIVES <br />1. Final the project and direct Staff to complete the project <br />close-out. <br />2.
