La Cadena Dr. OFFICIAL RECORDS <br />on, CA 92324 <br />'t2 �, 5 'l _ ► s_ _ 1991 APR 10 AM 10: 5 <br />Co., CALIF. <br />AGREEMENT AMENDING DRAINAGE EASEMENT <br />THIS AGREEMENT AMENDING DRAINAGE EASEMENT (this <br />"Agreement") is made this � day of 1991, by and between <br />the CITY OF COLTON, a general law city ("City") and PLAZA LAS <br />GLORIAS, a California Limited Partnership ("Developer") with <br />reference to the recitals set forth below. <br />RECITALS <br />A. Developer is the developer of certain real property <br />in the City of Colton, County of San Bernardino, State of <br />California more particularly described on Exhibit "A" attached <br />hereto and incorporated herein (the "Property"). <br />B. Developer is in the process of purchasing the <br />Property from Mount Vernon Shopping Center Associates, Ltd., a <br />California limited partnership pursuant to that certain Lease with <br />Option to Purchase dated January 2, 1990. <br />C. The Property is currently improved with a retail <br />shopping center known as Mount Vernon Plaza (the "Shopping <br />Center"). <br />D. Pursuant to that certain Grant Deed (Easement) dated <br />October 16, 1959 recorded in the San Bernardino County Recorder's <br />office on November 12, 1959 at Book 4979, Page 593 (the "Easement <br />Agreement"), an easement (the "Easement") was granted to the City <br />for drainage purposes over and across a portion of the Property as <br />more particularly described therein (the "Easement Area"). <br />E. Developer now proposes to expand the existing <br />Shopping Center pursuant to its development application submitted <br />to the City of Colton on June 25, 1990. Said expansion will <br />involve construction of buildings and related improvements over the <br />Easement Area. <br />F. On January 2, 1991 at a duly held meeting of the <br />City Council of the City (the "City Council"), the City Council <br />approved and consented to the construction of buildings and <br />improvements over the Easement Area upon the terms and conditions <br />set forth herein.
