Maylon, appellant, was heard by the Civil Board January 17, <br />23 and 28, 1991. <br />Member Margaret Matich did not participate. This is the report of the findings and <br />recommendations of the Board. <br />STATEMENT OF THE CASE <br />November 14, 1990, there was an incident involving Appellant, Victor M. Maylon <br />(Maylon) and a co-worker, Guadalupe Rubio (Rubio). In that incident, Rubio's right little <br />finger was broken. There are various conflicting versions of the critical event of this incident. <br />Only Maylon and Rubio actually witnessed the critical event of the incident, although other <br />employees were in the vicinity at the time. <br />November 14, 1990, Maylon, Rubio and other members of a City electric work crew <br />were engaged in electric work. They were working just at the top of a slope. Maylon and <br />Rubio rolled down the slope together. As they came back up Rubio had a broken finger. <br />Maylon says that the incident occurred as follows.- <br />Maylon <br />ollows. <br />Maylon was squatting down looking for a piece of material on the ground.
