FINDINGS OF FACTS <br />Rubio incident of November 14, 1990. <br />The Civil Service Board finds that there is not enough evidence to establish the truth <br />of the following: that Maylon engaged in an altercalion with Rubio, that in an altercation, <br />Maylon grabbed Rubio's finger and bent or twisted it until it broke, that Maylon was the <br />aggressor, that Rubio requested Maylon to stop hurting his finger, that as a result of Maylon Is <br />aggression a fight developed with Rubio that was witnessed by co-workers. <br />The evidence does not establish that Maylon assaulted Rubio. The Civil Service Board <br />finds that the facts as to the Rubio incident alleged by the City in the Notice of Termination <br />are not supported by the evidence presented to the Civil Service Board at the hearing. <br />RECOMMENDATIONS <br />The Civil Service Board recommends that the appeal be sustained, that the termination <br />be revoked, that Maylon be reinstated to his position and employment with the City. There <br />should be no disciplinary action taken against Maylon. <br />It is further recommended that the City provide Maylon with counselling and training <br />with regard to: City policies and practices, expected conduct with co-workers and with <br />supervisors, conduct during breaks and the duties and responsibilities of his position. <br />It is further recommended that the City deliver to Maylon copies of written materials <br />which set out such matters, have him acknowledge receipt for them in writing, and in not over <br />three months, follow-up with an evaluation and review of his progress and performance. <br />-6- <br />
