In addition to being subject to certain other specific sections of the CVC
operators of all of these vehicles are subject to special regulations adopted
by the CHP, which are found in Title 13, California Code of Regulations (13
CCR). Some of the regulations apply to all of the vehicles listed above, and
some do not. If a regulation only applies to a specific type or types of
vehicles, it will so state. However, in the absence of such a stated
limitation, a regulation will apply to all of the types of vehicles listed in
Section 34,500 CVC. (See 13 CCR 1200 (b) for information concerning two -axle
trucks used to transport hazardous materials). The regulations cover a
variety of subjects, all of which relate in some way to the safe operation of
vehicles which, because of their size or the loads of passengers or freight
they carry, could pose an extraordinary threat to public health and safety.
Some of the laws and regulations in the CVC and 13 CCR discuss acts and
procedures which must be carried out by the owners of regulated vehicles, or
by the operators, by the drivers, or others. Some laws and regulations discuss
equipment which is required to be carried in, mounted on, or otherwise be
present on specified vehicles subject to those requirements. Some of the laws
and, regulations discuss the manner in which these vehicles and their equipment
must be maintained. This guide will not attempt to list the equipment,
vehicle registration, or hazardous materials requirements for each of the
vehicles listed in 34500 CVC, except where those matters may touch upon
responsibilities related to vehicle maintenance. This guide will summarize
only those requirements that relate to maintenance of CHP -regulated vehicles
and the records that are required to be kept in connection with that
maintenance. In addition, certain other matters will be discussed relating to
CHP inspection of motor carrier terminals.
REFERENCED CODES
As a minimum, The CHP recommends that motor carriers obtain copies of the
California Vehicle Code and of Title 13, California Code of Regulations,
Chapter 2, as these two publications contain most of the laws and regulations
applicable to most motor carriers. Those motor carriers who transport
hazardous materials or who operate in interstate commerce should also obtain
copies of the appropriate parts of Title 49, Code of Federal Regulations. See
Annex A for addresses where the referenced publications can be purchased.
DEFINITIONS
Unless otherwise indicated, this guide refers to specific vehicle types as
they are defined in the: California Vehicle Code. Some of the vehicle defined
in the Vehicle Code have many exceptions. Several kinds of buses are briefly
described in Annex B of this guide. These definitions are not to be construed
as having any legal standing, but are provided for convenience to the reader.
A full understanding of the complete definition of a vehicle type requires
that the Vehicle Code be consulted.
HPG 84.6 1-2
