STRATTON, CHIEF OF POLICE <br />SUBJECT: SAN BERNARDINO COUNTY'S BOOKING FEES Date: 5-20-91 <br />BACKGROUND <br />The State Legislature, in the late hours of the 1990 legislative <br />session, approved SB2557 allowing counties to charge cities booking <br />fees, pitting cities against counties. <br />STATEMENT OF PROBLEM <br />San Bernardino County adopted booking fees in January, 1991, over the <br />protests of all the cities and law enforcement agencies of the <br />County, including the Sheriff. All 22 cities in the County filed <br />suit against San Bernardino County in Superior Court, Case #262309. <br />San Bernardino County began billing cities for booking fee charges <br />retroactive to July 1, 1990. The cities protested such charges <br />pursuant to Government Code Section 907. San Bernardino County began <br />offsetting such booking fee charges against property tax and other <br />revenues legally obligated to the cities in violation of State law. <br />ALTERNATIVES <br />Take no action. <br />FINANCIAL IMPACT <br />Approximately $250,000 <br />ENVIRONMENTAL IMPACT <br />None. <br />Attachments: <br />Page 1 of_2 _ Item No.L_ <br />
