1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />211 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 1 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, OFFICIALLY PROTESTING SAN BERNARDINO <br />COUNTY'S ILLEGAL OFFSET OF COUNTY BOOKING FEE <br />CHARGES AGAINST CITY PROPERTY TAX AND OTHER <br />REVENUES. <br />WHEREAS, the State Legislature, in the late hours of the <br />1990 legislative session, approved SB2557 allowing counties to <br />charge cities booking fees, pitting cities against counties; and <br />WHEREAS, San Bernardino County adopted booking fees in <br />anuary, 1991, over the protests of all the cities and law <br />nforcement agencies of the County, including the Sheriff; and_ <br />WHEREAS, all 22 cities in the County filed suit against San <br />rdino County in Superior Court, Case #262309; and <br />WHEREAS, the County began billing cities for booking fee <br />es retroactive to July 1, 1990; and <br />WHEREAS, the cities dutifully protested such charges <br />uant to Government Code Section 907; and <br />WHEREiu, April, 1991, the County began offsetting such <br />booking fee'eha&gees against property tax and other revenues <br />1ega11y obliqa� to the cities in contravention to State law; <br />NOW, THEREFORE BE IT RESOLVED that the City of Colton hereby <br />officially protests San Bernardino County's illegal offset of <br />1 <br />
