CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of November 5, 1991 <br />TO: Honorable Mayor and City Council <br />FROM: Leslie Keane Stratton, City Manager <br />0 <br />SUBJECT: <br />Certification Of Initiative Petition -- <br />Councilmanic District <br />BACKGROUND: <br />Date: 10/31/91 <br />Colton as a general law city, absent an ordinance to the contrary, elects <br />its council members from the community at large. Government Code Section <br />34871 allows cities, with a vote of the people, to adopt an ordinance <br />establishing electoral districts and to elect council members "by" or <br />"from" these districts. Election "by" district limits those who may be <br />candidates for city council and those who may vote to specific geographic <br />districts. Election "from" district requires council members to reside <br />in specific districts, but allows all city residents to vote on <br />candidates from every district. Cities who elect their mayors separately <br />may choose to establish four, six, or eight councilmanic districts. <br />Government Code Section 34872 sets out specific requirements for a <br />district election ordinance. The ordinance must include the following: <br />1. The number of districts proposed. <br />2. A description of the boundaries of each district. <br />3. A numbering of each district. <br />4. A statement as to whether council members will be elected "by" <br />or "from" districts. <br />DISCUSSION• <br />As the Council is aware the "Colton Voters For Fair Representation <br />Committee" ("Committee") has submitted a petition to the City that would <br />place an initiative ordinance on the ballot establishing election of <br />Colton Council Members "by" district. The proposed initiative ordinance <br />establishes six councilmanic districts and provides for at -large election <br />of the mayor. The proposed ordinance was submitted to the City Clerk's <br />office on May 31, 1991. City Attorney, Stephen Edwards, prepared a <br />summary of the ordinance and established a ballot title. The petition, <br />with 4,712 signatures was submitted to the City Clerk on October 10, <br />1991. The City Clerk's office has verified signatures in accordance with <br />Elections Code Section 3708 and is prepared to certify the petition as <br />Attachments: <br />Page 1 of _ ---a <br />Item No. <br />CENTRAL RECORDS <br />FILE NO-------------------- <br />
