SENT BY:BB&K ONTARIO
r,
M
;11- 1-91 ;12:45PM ; BEST,BEST & KRIEGER-+ 7143705154;# 2
October 31, 1991
00971DUTIAL
ATTORNZY-CLIBUT PRIPILIGN
TO: MAYOR, CITY COUNCIL, CITY MANAGER
CITY OF COLTON
FROM: CITY ATTORNEY
SUBJECT: INITIATIVE ORDINANCE; ELECTION OF COLTNCII14MBERS BY
DISTRICT
XN rRODU=1oN
The Colton Voters for Fair Representation Committee
(the "Committee") has submitted a petition to the City that would
Place an initiative ordinance on the ballot establishing election
of Colton City Councilmembers by district.
The proposed initiative ordinance establishes six
councilmanic districts and provides for the at -large election of
the mayor. However, the initiative ordinance fails to describe
the geographic boundaries of the districts; rather, the
initiative ordinance directs a panel (to be established by the
Committee and the City Council) to perform this task prior to the
November 1992 election. This omission is contrary to the
requirements of the Government Code and raises a question as to
whether the initiative ordinance as presented can be submitted to
a vote.
